1. Introduction
Welcome to my-doctor.ie (the “Site”). The Site is owned and operated by My Doctor Digital Health Limited, a company registered in Ireland with company number 805565, with its registered office and main trading address at The Black Church, St. Mary’s Place, Dublin 7, Ireland, D07 P4AX (“MyDoctor”, “we”, “us” or “our”).
These Terms of Use (“Terms”) govern your access to and use of the Site. They affect your legal rights and obligations, so please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
We may update these Terms from time to time. The updated version will be effective once accessible on the Site. You are responsible for reviewing the Terms regularly to stay informed of any changes.
2. Other applicable terms
These Terms should be read alongside:
- our Privacy Policy, which explains how we handle your personal data and special category health data; and
- our Terms of Sale (where you purchase a service through the Site).
Where you book or receive a medical consultation, additional terms may apply to that clinical service (including consent, clinical responsibility, prescriptions and continuity of care). In the event of any conflict, those clinical service terms will take precedence for the consultation.
3. Important medical notice (information vs consultation)
Information made available on the Site is provided for general information purposes and does not constitute medical advice. Medical advice, diagnosis or treatment is provided only as part of a booked consultation with a registered medical practitioner.
Not for emergencies
Our services are not suitable for medical emergencies. If you believe you are experiencing an emergency, you should immediately contact emergency services or attend your nearest emergency department.
Appropriateness of telemedicine
Telemedicine is not suitable for every condition or situation. The clinician will determine whether telemedicine is appropriate for your needs and may recommend an in‑person assessment, onward referral, diagnostic tests or alternative care pathways where clinically required.
4. Access to the Site
Access to the Site is permitted on a temporary basis. We may withdraw, suspend, discontinue or change all or any part of the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period.
You are responsible for:
- making all arrangements necessary for you to access the Site; and
- ensuring that anyone accessing the Site through your internet connection is aware of these Terms and complies with them.
We may restrict access to certain parts of the Site at our discretion.
5. Accounts, login details and security
Where you create an account, you must keep your login credentials (including email address, password and any authentication method) confidential and must not share them with any third party.
You are responsible for all activity on your account. If you believe your account has been compromised, you must notify us promptly at support@my-doctor.ie.
We may disable or suspend your account or access to the Site if we reasonably believe you have breached these Terms or where it is necessary for security, safety or compliance reasons.
6. Acceptable use
You may use the Site only for lawful purposes. You must not use the Site:
- in any way that breaches any applicable local, national or international law or regulation;
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- to harm or attempt to harm minors in any way;
- to send or facilitate the sending of unsolicited advertising or promotional material (spam);
- to knowingly transmit data or upload material containing viruses, Trojan horses, worms, time‑bombs, keystroke loggers, spyware, adware or any other harmful programs or code designed to adversely affect the operation of any computer software or hardware.
You also agree not to:
- reproduce, duplicate, copy or re‑sell any part of the Site in contravention of these Terms; or
- access without authority, interfere with, damage or disrupt any part of the Site, the servers on which it is hosted, or any connected server, computer or database.
Attempting unauthorised access, interference or disruption may constitute a criminal offence under Irish law, and we may report relevant matters to the appropriate authorities and disclose information as required by law.
7. Information you provide (including for consultations)
Where you submit information through the Site (including where you complete forms in connection with a consultation), you agree that the information is true, accurate and not misleading to the best of your knowledge.
You acknowledge that providing incomplete or inaccurate information may affect the safety, appropriateness or outcome of a consultation, including whether treatment or a prescription is clinically suitable.
8. Telemedicine consultations – key terms
Where the Site enables telemedicine (phone or video) consultations, we aim to operate those consultations in line with the Medical Council’s telemedicine guidance, including the principles that standards of care, consent, confidentiality and record‑keeping apply equally to telemedicine as to face‑to‑face care.
8.1 Consent
The same principles of consent apply for telemedicine as for in‑person consultations. You will be asked to consent to:
- conducting the consultation by telemedicine; and
- any treatment proposed.
When appropriate, we may explain (in plain language):
- the appropriateness and limitations of telemedicine for your care;
- security and privacy risks associated with the technology used and measures taken to mitigate those risks; and
- whether any recording will be made and how notes/records will be retained.
8.2 Privacy, setting and technology
You are responsible for joining the consultation from a suitable private location. We may recommend you use a secure connection and a quiet, private space to help protect confidentiality.
8.3 Medical records and continuity of care
Notes of the consultation will be recorded in the same way they would be for a face‑to‑face consultation. Where clinically appropriate, we may ask for and record details of your GP and other healthcare providers to support continuity of care, and we may inform your GP that the telemedicine consultation has taken place.
8.4 Prescriptions
Prescriptions (where available as part of a service) are issued only at the independent clinical discretion of the consulting practitioner and are subject to clinical suitability. We do not guarantee that a prescription will be issued following a consultation.
9. Practice information, fees and advertising (Medical Council alignment)
We aim to ensure that any information we publish about our medical services is presented responsibly and in accordance with the ethical standards expected of registered medical practitioners, including the Medical Council’s guidance on fees, advertising and provision of practice information.
Accordingly:
- information about our services is intended to be factually accurate, evidence‑based and not misleading;
- we do not use coercive advertising practices directed at vulnerable patients (for example, inappropriate pressure‑based promotions for clinical treatment plans);
- where a doctor’s area of specialty is stated, it will only be described in a manner consistent with the doctor’s registration status (for example, specialty claims only where appropriately registered);
- any pricing information is provided transparently and may change from time to time (the price displayed at purchase/booking is the applicable price).
We also aim to comply with applicable Irish rules governing health‑related and medicines advertising and marketing communications (including restrictions on public advertising of prescription‑only medicines).
10. Linking to our Site
You may link to our homepage provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not:
- suggest any form of association, approval or endorsement by MyDoctor where none exists;
- establish a link from a website you do not own; or
- frame our Site on any other site.
We reserve the right to withdraw linking permission without notice.
11. Links from our Site
Where the Site contains links to third‑party sites or resources, these links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
12. Intellectual property rights
We are the owner or the licensee of all intellectual property rights in the Site and the material published on it. Those works are protected by copyright laws and treaties worldwide. All such rights are reserved.
You may print off one copy and download extracts of pages from the Site for your personal use, and you may draw the attention of others within your organisation to material posted on the Site.
You must not modify copies of any materials you have printed off or downloaded, and you must not use any illustrations, photographs, video or audio separately from any accompanying text.
If you print off, copy or download any part of the Site in breach of these Terms, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies you have made.
13. Warranties and availability
While we endeavour to ensure the information on the Site is correct, we do not warrant that content is always complete, accurate or up to date, or that the Site will be available without interruption.
Nothing in these Terms affects your statutory rights as a consumer under Irish law.
14. Liability
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any liability which cannot be excluded or limited under applicable law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with:
- use of, or inability to use, the Site; or
- use of or reliance on any content displayed on the Site.
If you are a business user, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
If you are a consumer, we provide the Site for domestic and private use. If you use the Site for any commercial or business purposes, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
15. Restriction, suspension and termination
We may restrict, suspend or terminate your access to the Site if we believe you have breached these Terms at any time, or where it is necessary for security, safety or compliance reasons. Any such restriction, suspension or termination will be without prejudice to any rights we may have in respect of your breach.
We may also remove the Site as a whole or any sections or features at any time.
16. Governing law and jurisdiction
These Terms, their subject matter and formation are governed by the laws of Ireland. You and we both agree that the courts of Ireland will have non‑exclusive jurisdiction.
